Chauffeur Independent Contractor Agreement
This Chauffeur Agreement governs the relationship between PSLuxor and independent Chauffeurs using the PSLuxor platform.
This policy is provided for general business purposes and does not replace legal advice. PSLuxor may update this policy at any time.
1. Independent Contractor Relationship
Chauffeurs are independent contractors and are not employees of PSLuxor. Nothing in this Agreement creates employment, partnership, joint venture, or agency relationship. Chauffeurs control working hours, availability, vehicle operations, and acceptance of ride opportunities.
2. Chauffeur Requirements
Chauffeurs must maintain a valid driver’s license, legally required insurance, accurate account information, completed Stripe payout onboarding, and compliance with local laws and regulations.
3. Vehicle Standards
Vehicles must be clean, professional, mechanically safe, properly registered and insured, and aligned with PSLuxor black-car standards. PSLuxor may reject vehicles not meeting platform standards.
4. Payments and Payouts
PSLuxor processes Rider payments through third-party payment processors. Chauffeur payouts are subject to Stripe verification, tax verification, fraud review, and applicable deductions. Commission structures may vary by vehicle type and market.
5. Taxes
Chauffeurs are solely responsible for federal taxes, state taxes, self-employment taxes, licensing requirements, and any filings required for their independent work. PSLuxor may issue IRS Form 1099 where required.
6. Conduct Standards
Chauffeurs must treat Riders respectfully, avoid discrimination and harassment, maintain professional appearance, keep vehicles clean, and avoid unsafe driving. PSLuxor may suspend or deactivate accounts for misconduct.
7. Platform Access
PSLuxor may suspend or terminate platform access for fraud, unsafe behavior, repeated cancellations, violation of platform rules, or failure to maintain documentation.
8. Background and Verification
Chauffeurs authorize PSLuxor and its partners to verify identity, licensing, payout information, and conduct background reviews where permitted.
9. Location Tracking Consent
Chauffeurs agree that PSLuxor may collect and use location while the Chauffeur is online, on duty, assigned to a ride or reservation, active on a ride, or when support, safety, dispatch, emergency, legal, navigation, or payment verification needs require it.
PSLuxor uses Chauffeur location for dispatch, safety, ride tracking, navigation, support, fraud prevention, and trip/payment verification. PSLuxor does not sell location data. Rider visibility is limited to the active ride after acceptance and ends when the ride is completed or canceled. Admin access to Chauffeur location is limited to operational needs and may be logged.
10. Agreement Updates
When PSLuxor updates required Chauffeur terms, privacy, safety, payout, or location policies, Chauffeurs may be required to accept the updated agreement before going online, accepting rides, or using the Chauffeur platform.
11. Limitation of Liability
PSLuxor is not responsible for vehicle costs, fuel costs, maintenance, insurance, taxes, or personal injury claims arising from Chauffeur operations.
12. Arbitration and Disputes
Any disputes may be subject to arbitration where permitted by law.
